This website is operated by The Kitchen Herbarry. Throughout the site, the terms “we”, “us” and “our” refer to the Kitchen Herbarry. Throughout the site the term "you" refers to a customer, user or website visitor. In this document the term "packaging" refers to the packet into which the product is directly placed. In this document the term "parcel" refers to any packaging required to ship the product to the customer.

The Kitchen Herbarry website, including all information and services available from this site are offered and conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

These terms and conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read these terms and conditions carefully before accessing or using our website. Any new features or tools which are added to the current website will also be subject to the terms and conditions. You can review the most current version of the terms and conditions at any time by contacting us. We reserve the right to update, change or replace any part of these terms and conditions by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

We reserve the right to refuse service to anyone, for any reason, at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our service without express written permission by us.

We only supply our products to locations which are geographically situated in The United Kingdom of Great Britain and Northern Ireland and the Crown Dependencies of the Isle of Man, Guernsey (including Alderney and Sark) and Jersey.

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction.

These terms and conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland.

Refill sizes are determined by volume. 1 refill contains approximately enough product to fill a 110ml capacity spice jar to a level which might reasonably be considered "full" with a product which has been settled by shaking and tapping the container, not compacting the contents.

We make every effort to ensure that weight per 1 refill displayed on the website is correct. Customers should be aware that weight per volume can vary between different supply batches of the same product due to, for example, small differences in particle size and minute differences in moisture content. The weight displayed on the website may, therefore, differ slightly from the weight displayed on the packaging.

Prices for our products are subject to change without notice. We reserve the right to amend errors or to update product information at any time without prior notice. In the event that a product is listed at an incorrect price due to photographical error, typographical error, or error in pricing based on information from our suppliers, we will have the right to refuse or cancel any orders placed for the product listed at the incorrect price.

In the event that an order is confirmed and/or your card has been charged prior to a pricing error being discovered you will be contacted prior to dispatch to confirm whether you wish to proceed with the order at the correct price. You will be fully refunded if you do not wish to proceed.

You agree to promptly update your account and other information, including your email address, so that we can complete your transactions and contact you as needed.

All images used on the website are subject to the copyright of The Kitchen Herbarry or their third parties and cannot be used or distributed without our written consent. Some of the images on the site use props such as pinch bowls, spoons or the product in its undried or unground form as well as the actual product to help illustrate the product. Customers should be aware that only the product listed in the ingredients will be supplied.

We are not responsible if information made available on this site is not accurate, complete or current. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time. We have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Information on this site may contain typographical errors, inaccuracies or omissions that relate to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct these errors at any time without prior notice.

We make every effort to process orders as quickly as possible, customers should be aware that order processing can take up to 5 working days (Monday to Friday) particularly during busy periods. Processing an order constitutes, blending (if applicable), packaging, preparing shipping parcel and dispatch.

We will not be held responsible for damages or losses that you may incur due to the orders not being dispatched within 5 working days.

We will not be held responsible for delays in delivery after dispatch including those caused by delivery company or natural disasters.

Our local delivery service will be carried out by our own drivers or drivers sub-contracted by us. Areas eligable for local delivery are displayed on our website and are subject to change at any time without prior notice. You are asked to supply information regarding a safe place for our local delivery drivers to leave a parcel should you not be avaialable to recieve it when our driver makes delivery. If you do not supply this information or the specified safe place is not accessible our driver will leave the parcel on your doorstep. We will not be held responsible for damage or theft which occurs to your parcel after it has been left on your doorstep.

Under the Consumer Protection (Distance Selling) Regulations 2000, if you change your mind about a product you have ordered you are entitled to a refund of the cost of the goods. The refund amount will not include the cost of shipping the product to you and will be processed within 30 days of receipt of the product by us provided that the the following conditions are met:

You inform us within 14 working days from the day of delivery that you have changed your mind.
The goods are sealed in their original packaging.
The goods are returned to us at your own expense within 14 days of you informing us of your change of mind.
The returned goods do not arrive with us damaged due to a shipping parcel inappropriate for the product contained therein.

You will be entitled to a refund of the cost of your product if the product is delivered with breached packaging (not including the shipping parcel). The refund amount, including the cost of shipping the product to you, will be processed within 30 days provided that the the following conditions are met:

You inform us in writing, either by email or by post, within 14 days of delivery.
You provide us with photographs which clearly show the breached packaging.
You provide us with the batch number of the product.

Food safety and hygiene is our top priority and all products are stored and handled in a professional and hygienic manner. Even though the farmers and processors put all the efforts to remove the seeds, stones or foreign objects from the product, some may remain. It is the customers responsibility to check the product before consumption or production. The Kitchen Herbarry is not responsible for any damage incurred by any seeds, stones or foreign objects found in the product.

The Kitchen Herbarry sources products from many places around of the world. Whilst we make every effort to ensure that our website contains the most up to date information, customers should be aware that the country of origin can change at very short notice depending on the market, time of year, weather and harvests.

Our products are packed in an environment that also handles nuts, peanuts, sesame seeds, mustard, celery, gluten, soy, milk and sulphured fruits.

All the nutritional information found on our website and labels are provided by the suppliers and processors of our products. The Kitchen Herbarry is, therefore, not responsible for any misinformation contained therein.

The Kitchen Herbarry is not liable for lost profits, indirect damages caused by interruptions in activity, costs of products recall, costs related to the processing of products or combining them with other products, costs of production or costs of loss of contractors.

We reserve the right at any time to modify or discontinue our service (or any part or thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of our service.

We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

Our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

In the event that any provision in these terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms , such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
